Terms of Service

Welcome to BrainVolt. These Terms of Service ("Terms") govern your access to and use of the BrainVolt platform, including any associated websites, applications, and services (collectively, the "Platform"), operated by Treasure Play Pte. Ltd. ("Company", "we", "us", "our"), a company incorporated in Singapore.

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform.

1. Eligibility

You must be at least 13 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features of the Platform, you may be required to create an account. You may register using an email address and password or through a third-party authentication provider (such as Google). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Description of Service

BrainVolt is an AI-powered data analytics platform that enables users to connect their data sources, discover insights through natural language conversation, and automate workflows. The Platform may include features such as conversational data queries, automated reporting, third-party integrations, and collaborative tools.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

4. User Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and disclose your personal data. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

You retain all rights to the data you submit to or connect with the Platform ("User Data"). By using the Platform, you grant us a limited, non-exclusive, worldwide license to access, process, and display your User Data solely for the purpose of providing and improving the Platform and its services to you.

5. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law, regulation, or third-party rights.
  • Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, computer systems, or networks connected to the Platform.
  • Interfere with or disrupt the integrity or performance of the Platform or the data contained therein.
  • Use the Platform to transmit any malware, viruses, or other malicious code.
  • Use the Platform for any purpose that is fraudulent or otherwise prohibited by these Terms.
  • Reverse-engineer, decompile, or disassemble any aspect of the Platform, except as permitted by applicable law.
  • Use automated means (bots, scrapers, etc.) to access the Platform without our prior written consent.

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.

6. Intellectual Property

The Platform and its original content, features, and functionality are and will remain the exclusive property of Treasure Play Pte. Ltd. and its licensors. The Platform is protected by copyright, trademark, and other laws of Singapore and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Treasure Play Pte. Ltd.

You retain ownership of all User Data you provide to the Platform. Nothing in these Terms transfers ownership of your User Data to us.

7. Third-Party Integrations

The Platform may allow you to connect to and interact with third-party services, including but not limited to Google Workspace, Slack, GitHub, and BigQuery ("Third-Party Services"). Your use of Third-Party Services is subject to the respective terms and privacy policies of those providers. By connecting a Third-Party Service, you authorize us to access and process data from that service on your behalf, solely for the purpose of providing the Platform's functionality to you.

We are not responsible for the availability, accuracy, or content of any Third-Party Services, and we do not endorse any Third-Party Services. Any reliance on Third-Party Services is at your own risk.

8. AI-Generated Content

The Platform uses artificial intelligence to generate insights, analyses, and other outputs ("AI Outputs"). While we strive for accuracy, AI Outputs are provided for informational purposes only and should not be relied upon as the sole basis for making decisions. We do not guarantee the accuracy, completeness, or reliability of AI Outputs. You are responsible for independently verifying any information obtained through the Platform.

9. Fees and Payment

Certain features of the Platform may be offered on a paid basis. If you choose to subscribe to paid features, you agree to pay the applicable fees as described on the Platform. We reserve the right to change our pricing at any time, with reasonable notice to existing subscribers. All fees are non-refundable except as expressly stated otherwise or as required by applicable law.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TREASURE PLAY PTE. LTD., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (III) ANY CONTENT OBTAINED FROM THE PLATFORM, INCLUDING AI OUTPUTS; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Treasure Play Pte. Ltd. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

You may terminate your account at any time by contacting us. Upon termination, we will make reasonable efforts to delete your User Data within a reasonable period, except as required by law or legitimate business purposes (such as resolving disputes or enforcing our agreements).

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Singapore.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, by posting the updated Terms on the Platform and updating the "Effective" date above. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or agreements published by us on the Platform, constitute the entire agreement between you and Treasure Play Pte. Ltd. regarding the Platform and supersede any prior agreements.
